Leaseholder rights.
By law leaseholders have the right to:
- Extend the lease or buy the freehold of a house under the Leasehold Reform Act 1967
- Extend the lease or buy the freehold of a flat provided that certain criteria are met
- To be able to buy the freehold of a flat when it is sold, under the Landlord and Tenant Act 1987
- To be provided information on how to challenge service charges by the freeholder
- The leaseholder is able to form a company which can take responsibility for block management
Tenants rights.
As a tenant, you have the right to:
- live in a property that’s safe and in a good state of repair
- have your deposit returned when the tenancy ends – and in some circumstances have your deposit protected
- challenge excessively high charges
- know who your landlord is
- live in the property undisturbed
- see an Energy Performance Certificate for the property
- be protected from unfair eviction and unfair rent
- have a written agreement if you have a fixed-term tenancy of more than 3 years
